Terms and Conditions

Before using or obtaining any materials, information, services through this online store, please carefully read the Terms and Conditions. These provisions are supplemented by Law 365/2002 on electronic commerce, republished and amended, and by Government Emergency Ordinance 34/2014 regarding consumer rights in contracts concluded with professionals.

1. Information about the online store administrator

2. Acceptance of Terms and Conditions of Use

The administrator provides you with access to the online store and its usage, subject to your acceptance of these terms and conditions. By accessing, using, obtaining, or purchasing any product, content, data, materials, information, or services through our online store, you agree to abide by these Terms and Conditions. The administrator reserves the right to supplement or modify any information in the virtual store without prior notice to the site users.

3. Copyright Rights

The Visitor/Buyer understands that the intellectual property rights to the content of the online store, including images, descriptions, graphic elements, are owned by the administrator and are protected in accordance with copyright laws and intellectual and industrial property laws. All works are the property of the artist Diana Cojocaru, and the copyright is retained even after the purchase of any product. Any purchase, whether it is a painting, scarf, jewelry, or any other creation made by Diana Cojocaru or any other artist creating under the company NICIO ZI FARA PICTURA SRL, does not imply the transfer of copyright.

4. Distance Contract Conclusion, Validity

By placing an order on the online store www.dianacojocaru.ro, the buyer agrees to communication via email or phone  through which the administrator  conducts its operations.
This distance contract becomes effective upon confirmation of the order by the  administrator. Confirmation can be made verbally (by phone) or electronically (via email).
The Terms and Conditions of the online store dianacojocaru.art  form the basis of the established contract.
The  administrator  does not consider any unconfirmed order to hold the value of a Contract under any circumstances.
The buyer becomes the owner of the goods after payment confirmation, in the case of payment by bank transfer or card, respectively after making the payment and signing the transport documents in the case of courier delivery.

5. Prices, Payment Methods, Invoicing

The prices are displayed on each product’s dedicated page, inclusive of VAT, and do not include delivery charges unless expressly specified or provided as a bonus for larger orders. If the price is not displayed, you will have the opportunity to request a quote, and an operator will communicate the price to you as soon as possible.
The price of the ordered product is the one displayed at the time the order is placed.
The price printed on the invoice is the same as the one communicated by the operators at the time of order confirmation.
The prices of products in the online store dianacojocaru.art may differ from those in physical stores.
The payment methods are available on the order placement page.
Based on the information held by dianacojocaru.art and provided by the buyer, an invoice will be issued for the delivered goods. Additionally, the parcel will be accompanied by the documentation required by law for the ordered product(s), as appropriate: certificate/declaration of conformity, warranty certificate, user instructions, etc.

6. Stock Availability

The products are available in stock. However, the administrator cannot guarantee the availability of the posted products. Customers are accurately informed, in accordance with the terms and conditions, about the availability of the ordered products before delivery confirmation. Occasionally, communication errors in this regard may occur.

7. Warranties

SC NICIO ZI FARA PICTURA SRL guarantees that the delivered products are original, sealed, and accompanied by a fiscal invoice. We declare, under our own responsibility, in accordance with the provisions of Article 5 of Government Decision no. 1022/2002 regarding the regime of products that may endanger life and health, occupational safety, and environmental protection, that the delivered products do not endanger life, health, occupational safety, do not have a negative impact on the environment, and comply with: EC Directives 67/549/EEC and 1999/45/EC. 8. Information Regarding the Exercise of the Right of Withdrawal

These provisions are complemented by Law 365/2002 on electronic commerce, republished and amended, and by Government Emergency Ordinance 34/2014 regarding consumer rights in contracts concluded with professionals.

Return Policy

In accordance with Government Emergency Ordinance 34/2014, you have the right to withdraw from this contract, without specifying reasons and without incurring penalties, within 14 days. The withdrawal period expires after 14 days from the day you or a third party, other than the carrier and indicated by you, acquires physical possession of the products.

To meet the withdrawal deadline, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the withdrawal period expires.

The consequences of withdrawal

If you withdraw, we will refund any amount received from you, excluding delivery costs, without undue delay and in any event not later than 14 days from the date we receive the products back in pristine condition. We will carry out this refund using the same means of payment as you used for the initial transaction. No fees will be charged to you as a result of such a refund. The refund will only take place after receiving the products back.
If you have received the products under the contract, please return the products without undue delay and in any event no later than 7 days from the date you communicated your withdrawal to us. The deadline is met if the products are posted before the expiry of the 14-day period.

The conditions for the right of withdrawal apply only to individual consumers, as defined in Article 2, point 1 of Government Emergency Ordinance 34/2014.
You will have to bear the direct cost of returning the products. The consumer is responsible for the integrity of the product until it is received by the store.  
You are responsible for any decrease in the value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products.
At the request and with the agreement of the consumer, dianacojocaru.art may recommend to the buyer the purchase of another product of equivalent quality and price to those requested in the first order. The initial order will be canceled upon confirmation of the order for the product/products that replace the initial product.

If you are considering returning the product, please do not use it! You cannot use the products you have received before making a decision regarding the cancellation of the sales contract. The right of withdrawal exists to allow you to examine the product as you would in a store, not to provide you with 14 days of free use.

It is not possible to return products that:
·      have been the subject of a special/custom order.
·      have been distinctly personalized at the consumer’s request
·      have been made according to the consumer’s specifications (e.g., custom coloration of the product as desired by the client)
·      show signs of impact, damage, or wear
·      have been unsealed and no longer have the intact original packaging, with all accessories and intact label.
·      are put in any way in a condition unsuitable for resale.
For products picked up by the buyer directly from the store, as the buyer has the opportunity to directly inspect the product, the return conditions specified in this section do not apply.

SC NICIO ZI FARA PICTURA SRL will bear the return costs if it is attributable to us. (The products received do not match the order, they are different from those requested when placing the order.)

9. Working hours, deliveries, deadlines

An order can be placed at any time, but the processing period is from Monday to Friday between 8 AM to 3 PM, excluding legal holidays.
The delivery period for products is 3 to 15 days from the moment of delivery confirmation. Depending on the destination country of the client.
Physical deliveries are carried out door to door, via courier, through the different fleets available for each contry, an outsourced service, thus independent of the  administrator. There might be delays compared to the delivery deadline established at the time of order confirmation; in such cases, the administrator does not assume any responsibility on behalf of the courier companies.
The administrator takes responsibility for the delivery of the products ordered by the buyer. The risk of loss of the goods is transferred to the buyer at the moment of actual delivery of the goods.

10. The obligations of the buyer

– To provide real, accurate, and current information about their entity when requested; otherwise, there is a possibility of order refusal.
– To accept the resolution of any issues within 30 days from the date of notification through an email addressed to the administrator.
– To accept the administrator’s TERMS AND CONDITIONS when placing orders and to pay the value of the goods through the provided methods at the time of order transmission.

11. The seller’s obligations

– To provide users with professional information about its products and services free of charge. The content published on the online store is for informational purposes. The characteristics of the products and their technical documentation displayed on the website are provided by the manufacturers and suppliers. The product images are displayed for presentation purposes. Depending on the batch in which they were manufactured, the actual appearance of the product may differ.
– To contact customers for order confirmation via email or telephone.
– To deliver the products within a maximum of 30 days from the delivery confirmation, if they are in stock.
– To use the personal data collected from customers/users in accordance with the ‘Privacy Policy’ section, an integral part of the TERMS AND CONDITIONS.

12. Disputes

General Terms and Conditions of Sale (GTCS)  are subject to Romanian law. In case of a dispute, if an amicable resolution is ineffective after filing a complaint at the company’s headquarters, legal action will be taken. NICIO ZI FARA PICTURA SRL is not liable for damages caused without its fault, for the non-functionality of the online store or those resulting from the inability to access the pages of the virtual store (e.g., internet network failures). Force majeure exempts the invoking party from responsibility.

Your rights and benefits

According to GDPR and Law no. 677/2001, you have the right to access, free intervention on data, the right not to be subject to an individual decision, and the right to appeal to justice. Also, you have the right to object to the processing of personal data concerning you and request data deletion*. To exercise these rights, you can submit a written, dated, and signed request, sent online via email to robert@dianacojocaru.art. Additionally, you have the recognized right to address justice.

By placing an order, you accept the processing of the following data for the purpose of issuing an invoice and a transport AWB.

The stored data is as follows:
First and Last Name – for billing purposes and issuing the transport AWB.
Phone Number – for issuing the transport AWB and your communication with our company and the company performing the delivery.
Address (street, number, block, apartment, sector/county, postal code) – for billing purposes and issuing the transport AWB.
Email address – for communicating information and details related to the order.

Your data will not be transferred to any external operator. NICIO ZI FARA PICTURA SRL company and the dianacojocaru.art brand do not transfer or offer for sale any customer data.

If some of your data is incorrect or you wish to modify it, please inform us as soon as possible
If you wish to delete your data from our servers, please send us an email specifying this, and we commit to deleting them within 7 days.
Please note that:
*any person has the right to oppose, for legitimate reasons, the processing of data concerning him. This right of opposition can be excluded for certain processing provided by law (eg: processing carried out by the financial and fiscal services, police, justice, social security). Therefore, this mention cannot appear if the processing is mandatory;
*any person also has the right to object, free of charge and without any justification, to the processing of their personal data for direct marketing purposes. 

We reserve the right to periodically update and amend this Privacy Policy to reflect any changes in the way we process your personal data or any changes in legal requirements. In case of any such change, we will display on our website the modified version of the Privacy Policy, which is why we ask you to periodically check the content of this Privacy Policy.
